Single Mom Countersues RIAA on RICO Charges


peertopeer.gifThe tide is turning for the RIAA, which, to date, has found a cash cow in the P2P lawsuits it has filed en masse against music fans. (I’m a big believer in copyrights, but come on — the RIAA is turning into the IRS of the entertainment world). Courtesy of Slashdot, another single mother has turned her potential victimhood into an assault on the RIAA’s legal tactics.

Single mother Tanya Anderson has filed suit against the RIAA for Oregon RICO violations, fraud, invasion of privacy, abuse of process, electronic trespass, violation of the Computer Fraud and Abuse Act, negligent misrepresentation, the tort of “outrage,” and deceptive business practices.

Like the other feisty, high-profile single mother targeted by the MPAA (see here and here,) Anderson claims that she did not download the music files discovered by the RIAA’s PC-snooping firm, and doesn’t understand why she has to pay up or get sued. RICO, for those who don’t know, stands for Racketeer Influenced and Corrupt Organization Act, the federal law passed in 1970 to crack down on criminal rackets.
